Baltovich's delayed retrial for Bain murder to get moving again next month

TORONTO - Robert Baltovich's delayed retrial for the murder of Elizabeth Bain will get moving again on Nov. 6 with pretrial motions.

The second-degree murder trial was entering jury selection last week when it was announced the presiding judge had been promoted to a higher court. That move saw the jury pool dismissed, a new judge appointed, and the trial delayed substantially.

Six motions already argued before the former judge must be argued again and decided before the trial begins, likely sometime in the new year.

Baltovich is accused of murdering his girlfriend Bain, who disappeared from east-end Toronto in 1990. Her body has never been found. It will be the second time Baltovich has stood trial on the charges. In 2004, the Appeal Court overturned the original lower court decision. The Crown has elected to retry Baltovich on a second-degree murder charge.
